I dont know if anyone knows about the De Beers Diamond Class action lawsuit. Here is the info I got back:


Your purchases do not have to have been made from a particular store, or made by a specific company. The Court has said that two types of classes are included, an indirect purchaser class and a direct purchaser class. The Indirect Purchaser Class includes companies and individuals located or residing in the United States on October 1, 2007 who purchased one or more “Diamond Products” from January 1, 1994 to March 31, 2006. The Indirect Purchaser Class has two different kinds of members or “subclasses”:

- The Indirect Purchaser Consumer Subclass consists of companies and people who purchased Diamond Products for personal use, or as a gift, and not for resale, and who must have lived in the United States on October 1, 2007.

- The Indirect Purchaser Reseller Subclass consists of companies and people located in the United States on October 1, 2007 who purchased Diamond Products for resale, such as jewelry companies, department stores, and diamond jewelry manufacturers.

The vast majority of people and companies who are in this Settlement are part of the Indirect Purchaser Class. Very few people or entities purchased directly from De Beers or its competitors. If you meet the criteria outlined above, you would qualify as part of the class.

You must complete and submit the appropriate Claim Form by May 19, 2008 to receive a payment, no matter what class you are in. For the Indirect Purchaser Consumer Subclass, complete the Consumer Claim Form. You can download a claim form from the website, then print and mail your completed form, or you can complete and submit your claim online at http://www.diamondsclassaction.com. If you file your claim online, you do not need to also print and mail your claim form. Please remember that you could be a member of more than one Class. If this is the case, you will need to complete a Claim Form for each Class.

You do not need to submit proof of your purchases with your Claim Form unless you are claiming that you purchased a diamond or piece of diamond jewelry that cost more than $10,000. The $10,000 limit does not apply to total purchases claimed, only individual pieces. However, you may need to send documents to the Claims Administrator to prove your purchases if the Claims Administrator requests them. Therefore, keep any documents you have that show proof of your purchases, such as a receipt, invoice, credit card statement, insurance statement, appraisal, certificate or any other documents showing the diamond’s or the diamond jewelry’s cut, clarity, color, number of carats, authenticity or the person or business from whom the diamond or diamond jewelry was bought. If proof of purchase is required, and you are unable to supply proof of your purchases, your claim could be denied. Please let me know if you have any additional questions. It does sound like if your claim is approved, you'll get something. I'm sure there is a set amount of money set aside for this, so it really will depend on how many people join the class action suit by the deadline. will be interesting to see!
